              <p>An outlyer’s view of this very interesting reform raises several issues from an international and comparative perspective. One may be the link established here between form and substance, of particular relevance in contract law; another could be the reach and scope of the new provisions as intended by the drafters, given their aim to capture new forms of contracting; and a third questions the method used to integrate foreign and European developments, with a view to widen the horizons of the reform.</p>

              <p>Un regard extérieur sur cette très intéressante réforme soulève plusieurs interrogations sur le registre international et comparatif. Ainsi, tout d’abord, on peut questionner le lien qui se dégage ici entre forme et substance – un lien particulièrement significatif dans le domaine du droit des contrats. Sur un autre terrain, il importerait de réfléchir à la portée et au domaine des nouvelles dispositions tels que voulus par les rédacteurs, dont on sait l’ambition de saisir des nouvelles formes contractuelles. Enfin, on peut se demander quelle méthode a été suivie pour intégrer le fruit des expériences européennes ou étrangères en vie d’élargir les horizons de la réforme.</p>
