The Question of Contingent Protection

Abstract

The Uruguay Round of Multilateral Trade Negotiations, formallyconcluded on 15 April 1994 in Marrakesh, led to the adoption by theWTO Members of new Agreements dealing with the major instruments ofcontingent protection, i.e. Anti-dumping, Countervailing and Safeguard Measures.But the new Agreements have not diminished the intensity of thecontroversy surrounding the use of contingent protection, particularly antidumping(AD) measures. It is clear that a serious debate about the rationale of thedefinition of dumping as it is now contained in Article 2 of WTO (1994) cannotbe endlessly postponed (...).
